Zoning Bylaw, Nuisance, Noise, DEP
Represented
a residential neighborhood group in central Massachusetts objecting
to the level of noise emitted by a nearby 24 hour trucking facility.
The noise interfered with the neighbors’ use and enjoyment of their
property and interrupted their sleep. Senie and Associates, P.C.
raised issues of zoning bylaw violations and nuisance. Working with
an environmental noise consultant, we proved that the trucking
facility violated Department of Environmental Protection (DEP)
standards for noise pollution and was operating in violation of the
zoning bylaws. After hearings at the town level and the Land Court,
the case was settled when the trucking company installed a 16 foot
high, 1,100-foot long noise barrier wall in addition to improving
their operations to reduce noise emissions.

Represented
a neighborhood group which was suffering due to noise emitted from a
Cape Cod business’ exhaust fan system. Our firm spearheaded a joint
effort by the Town and the local business to install new exhaust
fans bringing the facility into compliance with the Department of
Environmental Protection regulations.

We assisted an individual homeowner in her efforts to remediate her
property in the wake of an environmental spill caused by a
contractor working at the residence. We assisted the client in
coordinating cleanup efforts, complying with DEP regulations,
interfacing with licensed site professionals, and navigating the
insurance claims process.
